These Terms and Conditions (“Terms”) govern the services provided by Huy Cool Refrigeration LLC (“Company,” “we,” “our,” or “us”) to our customers (“you” or “your”). By requesting or receiving services from us, you agree to these Terms.
1. Services Provided
We specialize in refrigeration and cooling solutions for hospitals, commercial buildings, and other facilities. Our services include preventive maintenance, repairs, installations, and special projects.
All services will be performed in a professional and workmanlike manner, consistent with industry standards.
2. Estimates and Invoices
- Written estimates are provided before work begins when possible.
- Final invoices may differ from initial estimates due to additional parts, labor, or unforeseen conditions.
- Payment terms are [insert terms, e.g., “Net 30 days from invoice date”]. Late payments may be subject to interest or collection fees.
3. Customer Responsibilities
You agree to:
- Provide safe and reasonable access to the equipment and work area.
- Disclose any known issues with equipment or utilities prior to service.
- Maintain any required permits, approvals, or authorizations for work performed at your property.
4. Equipment and Parts
- Replacement parts will be new, unless otherwise agreed.
- Manufacturer warranties may apply to certain parts and equipment.
- We are not responsible for manufacturer defects or failures outside of our control.
5. Preventive Maintenance Limitations
Preventive maintenance reduces the likelihood of breakdowns but does not guarantee uninterrupted operation of equipment. Unexpected failures may occur even with regular maintenance.
6. Warranties
- We provide a 30-day workmanship warranty on labor.
- Equipment and parts are subject to the manufacturer’s warranty.
- Warranties are voided if equipment is tampered with, altered by unauthorized personnel, or not properly maintained.
7. Liability
- We are not liable for indirect, incidental, or consequential damages, including lost income or product loss, arising from equipment failure.
- Our liability is limited to the cost of services provided or equipment installed under the applicable invoice.
8. Cancellations and Rescheduling
- Please provide at least [24/48 hours] notice to cancel or reschedule service.
- Missed appointments may be subject to a service call fee.
9. Disposal of Equipment
- Upon request, we can remove and dispose of old equipment for an additional fee.
- Certain disposal may require environmental handling fees (e.g., refrigerants).
10. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts located in Harris County, Texas.
11. Updates
We may revise these Terms at any time. Updates will be posted on our website with the new effective date.
